1. Introduction

Welcome to Arkova Technologies ("we", "our", or "us"). These Terms and Conditions govern your use of our software development, mobile app development, web development, and IT consulting services.

By engaging with our services, you agree to these terms in full. If you disagree, please discontinue use of our services immediately.

2. Our Services

  • Custom software development including enterprise solutions and SaaS applications
  • Mobile application development for iOS and Android platforms
  • Web development and e-commerce solutions
  • UI/UX design services
  • IT consulting and digital transformation services
  • All services are provided on a project basis with individual agreements

3. Engagement Process

  1. Requirement Analysis: Initial consultation to understand project scope
  2. Proposal: Detailed project proposal with timelines and cost estimates
  3. Agreement: Signed contract and 30% advance payment to commence work
  4. Development: Regular updates and milestone deliveries
  5. Delivery: Final payment upon project completion

4. Intellectual Property

Unless otherwise agreed in writing:

  • All source code, designs, and deliverables become client property upon full payment
  • We retain the right to showcase completed work in our portfolio
  • Open-source components used remain under their respective licenses

5. Payments & Pricing

Payment Terms

  • 30% advance payment to initiate projects
  • 40% upon delivery of beta version
  • 30% upon final delivery and acceptance
  • All invoices payable within 15 days

Refund Policy

Due to the custom nature of our services:

  • Advance payments are non-refundable
  • Partial refunds may be considered for terminated projects at our discretion
  • No refunds after project completion and final delivery

6. Confidentiality

We adhere to strict confidentiality standards:

  • All client information is protected under NDA (Non-Disclosure Agreement)
  • Project details are never shared with third parties without consent
  • Data security measures aligned with industry best practices

7. Support & Maintenance

  • Warranty Period: 30 days bug-fixing support post-delivery
  • Ongoing Support: Available through separate maintenance contracts
  • Response Times: 24 hours for critical issues, 72 hours for standard requests

8. Limitation of Liability

Arkova Technologies shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Losses resulting from third-party services or platforms
  • Issues arising from client-provided materials or specifications

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad.
